Al-Kazemi pointed out that “the obstruction in sending remittances to traders occurs by the US Federal Bank on the pretext of preventing the smuggling of dollars out of Iraq, but this measure prompted traders to go to the parallel market in order to pay their trade obligations.”

Al-Kazimi pointed out that “the central bank authorizes private banks to deal with traders and does not deal directly with them, and the Federal Bank hinders sending remittances to traders, and this is what created the gap between the dollar exchange rate.”

He pointed out that “the issue of the rise in the dollar exchange rate because there are no benefiting from the difference between the official and parallel price, and this has misled the market,” noting that “the government must intervene to solve this crisis.”

Al-Kazimi explained that “the Finance Committee was preoccupied with the budget during the previous period, and if the difference continues to widen, the reasons must be identified and the Governor of the Central Bank should be hosted and who is responsible for the exchange rate from the executive authorities to solve the crisis, indicate who is behind it, hold them accountable, follow up on private banks and the question of remittances to traders and monitor them.”

He pointed out that “if the dollar continues to be smuggled, the exchange rate will continue to rise as the government’s role in monitoring smuggling operations is weak, and the Central Bank should exercise its role in monitoring the procedures that accompany remittances and knowing the reasons that drive traders to take out these large quantities of dollars abroad.”

After the Iraqi judiciary issued an order to seize the funds – movable and immovable – of former Iraqi Prime Minister Mustafa Al-Kazemi, as part of an investigation he is conducting about his inflated wealth, experts and observers expected that arrest warrants would be issued against him or he would be tried in absentia before his money was confiscated.

The Integrity Commission, which is charged with investigating major corruption files, has previously arrested a number of former officials, including an advisor in Al-Kazemi’s office, and other officials close to him.

The judiciary did not issue a decision to arrest Al-Kazemi and prevent him from traveling, but previous arrests of a number of officials in his government gave the impression that the noose on Al-Kazemi’s inner circle began to approach him personally.

And last Friday, the Prime Minister, Muhammad Shia’ al-Sudani, confirmed that fighting corruption and combating its causes came at the top of the government’s priorities, and “there is no red line in this file, which caused the waste of wealth and the delay in projects.”

Al-Kazemi’s mistakes
Regarding legal procedures and binding judicial decisions against Al-Kazemi, Fadel Al-Badrani, a researcher in political affairs and professor of media at the Iraqi University, says that they may fall within the framework of accountability for the mistakes Al-Kazemi committed during his tenure as prime minister (2020-2022).

Al-Badrani believes, in an interview with Al-Jazeera Net, that the matter is likely to have more than one opinion:

the first is that the Al-Kazemi government has had serious lawlessness, and a lot of money has been squandered for the state and with his knowledge.
The second is political, which is that political forces fear that Al-Kazemi will return to the forefront through the provincial elections, as he is supported by America and the West, which prompted those forces to pressure towards searching for and revealing the mistakes that accompanied his rule.
It was previously reported that the former prime minister had left Iraq, but he denied the news. While investigations continue in the “theft of the century” case related to the embezzlement of $2.5 billion from tax secretariats in the government-run Rafidain Bank.

In late February, the Integrity Commission opened an investigation into the financial disclosure of Al-Kazemi, amid accusations of illicit gain, confirming the request that he provide the commission with details about a property in the “Karada Maryam” area in central Baghdad and problems about a bank account belonging to him.

Steps following the reservation of funds
In his explanation of the reasons for seizing Al-Kadhimi’s money, legal expert Ali Al-Tamimi confirms that the Iraqi Penal Code No. 23 of 1971 stipulates in Article 183 and thereafter the “seizure of any fugitive suspect’s money, movable and immovable,” while Article 184 obligated the investigating judge or court. This reservation is based on the request of the Public Prosecution or the administrative authority.

Al-Tamimi told Al-Jazeera Net that this detention remains until the results of the case appear and another decision is issued, which is a precautionary detention and then the trial, which is either in presence in the event of the arrest of the accused or in absentia if the accused is a fugitive according to Article 143. And last May, Major General Diaa al-Musawi, who is close to Al-Kazemi, turned himself in to the Supreme Committee for Combating Corruption, and provided information about personalities in Al-Kazemi’s office who were involved in what is known as the “theft of the century,” after he returned to Iraq. He left for a while and then decided to turn himself in to the relevant authorities.

And while Haitham Al-Jubouri, the financial advisor to Al-Kazemi, was arrested due to his money inflating in unknown ways, in November of last year, an arrest and search warrant was issued by the Integrity Commission against Mashreq Abbas, the political advisor to Al-Kazemi, due to his failure to disclose the financial disclosure.

The arrest warrant for Al-Jubouri, who was later released on bail, came on the background of confessions to the judicial authorities made by Nour Zuhair, the owner of Al-Ahdab Company and the main suspect in the “theft of the century” case. Investigations are still underway to uncover other people involved in the theft.

Political projection
Contrary to what some experts and observers believe that Al-Kazemi committed many violations and mistakes and was involved in corruption cases, the director of the Iraqi Center for Strategic Studies, Ghazi Faisal, believes that attempts to punish Al-Kazemi fall within the framework of “political misconduct” by referring him to the judiciary under various charges, including financial corruption. Especially since some political forces had previously launched a campaign of threats against him, describing him as a “traitor” and attacking his residence with a drone in the Green Zone, noting that this targets Al-Kazemi’s personality, presence, and constitutional powers.

Faisal tells Al-Jazeera Net that Al-Kazemi was also subjected during his tenure to a harsh campaign when he initiated a ministerial change in his government, and charges were leveled against him that were not based on facts, and this reflected the depth of the political and ideological dispute between those organizations that brought Al-Kazemi and supported his candidacy to head the government, and it quickly overturned.
