The Federal Supreme Court decides the case No. 132 and its units / Federal / 2022

The Federal Supreme Court considers:

1. The members of the House of Representatives, after being elected, do not represent themselves or their political blocs, but rather the people. Therefore, it was necessary for them to work to achieve what they were elected for, which is the people’s interest, not to be a reason to obstruct their interests and threaten their safety and the safety of the people completely.

2. The stability of the political process in Iraq requires everyone to abide by the provisions of the constitution and not to exceed it, and no authority may continue to exceed the constitutional periods indefinitely, because this is a violation of the constitution and the demolition of the entire political process and a threat to the security of the country and citizens.

3. The penalty imposed on the House of Representatives for not carrying out its constitutional duties is to dissolve the House when there are justifications for it.

4. The Constitution of the Republic of Iraq for the year 2005 has drawn up the constitutional mechanism for dissolving the House of Representatives in accordance with the provisions of Article (64/First) thereof.

5. The jurisdiction of the Federal Supreme Court is limited by Article (93) of the Constitution and Article (4) of the Federal Supreme Court Law and does not include the dissolution of Parliament.

6. The Constitution of the Republic of Iraq for the year 2005 did not overlook the regulation of the provisions of the dissolution of Parliament, and therefore there is no room for applying the theory of constitutional omission.

money and business

Economy News – Baghdad

The credit rating agency, Fitch, expected the real GDP growth for Iraq by about 8 percent in 2022, after it was 3 percent in 2021.

The agency stated in a report that “the increase in the average annual oil production will lead to a recovery of 11 percent in the oil GDP in 2022, which was a constant average in 2021, despite the increase in production rates in the second half of the year 21.”

“Rapid lending growth, supported in part by lending initiatives from the Central Bank of Iraq, will drive non-oil growth by 4 percent this year,” the report added.

Although there are some formal restrictions on economic activity linked to the Covid-19 pandemic , they have become largely irrelevant in practice.

The one who appealed the resignation of the Sadr MPs: My goal is one, and I will not withdraw the case

 2022-09-07 05:50A-AA+

Shafaq News/ The complainant of the appeal against the resignation of the Sadrist bloc deputies, Lawyer Diaa Al-Budairi, confirmed on Wednesday that he has continued to file the appeal before the Federal Court (the highest judicial authority in Iraq).

A number of deputies and leaders of the Sadrist bloc denied any connection with the lawsuit submitted to the Federal Court, to challenge the acceptance of the resignation of the Sadrist bloc’s deputies from Parliament.

Al-Budairi told Shafaq News Agency, “The news that talks about the withdrawal of the lawsuit that it submitted to the Federal Court regarding the resignation of the Sadrist bloc’s deputies is incorrect,” adding, “I am going with this lawsuit, and the goal of it is not the Sadrist bloc, but the uniqueness of the parliament speaker and his taking decisions that violate the constitution and the law.” “.

Parliament Speaker Muhammad al-Halbousi signed the resignations of the Sadrist bloc’s deputies, in the presence of the parliamentary bloc’s leader, Hassan al-Adhari, and then commented, “Their resignations took place reluctantly,” referring to efforts made to dissuade al-Sadr from this step.

The lawyer added, “Two unknown personalities contacted him and said that they were from the Sadrist movement, and asked to withdraw the case, but he refused,” pointing out that “withdrawing the case is possible after the official request of the Sadrist movement and through the well-known figures of the movement such as (Hassan Al-Adhari, Hakim Al-Zamili, Hazem al-Araji), or the leader of the Sadrist movement, Muqtada al-Sadr himself. Otherwise, the case will not be withdrawn.

And the Federal Court announced, last Sunday, that it had received a lawsuit to challenge the acceptance of the resignations of the Sadrist bloc deputies by the Presidency of the House of Representatives (in the number 181 / Federal / 2022), and set the date for the first session to consider the case on September 28, 2022.

Talabani on the differences between Erbil and Baghdad: We have no problem with those who sell oil

KurdistanErbilAmericaBaghdadTalabanidifferences

 2022-09-07 05:48A-AA+

Shafaq News/ Qubad Talabani, Deputy Prime Minister of Kurdistan Region discussed today, Wednesday, with Barbara Leaf, Assistant Secretary of State for Middle Eastern Affairs of the United States of America, the latest political developments in Iraq in addition to the differences and outstanding issues between Erbil and Baghdad.

During the meeting, which was attended by the US ambassador to Baghdad, Elena Romanowsky, the differences between Erbil and Baghdad on the issue of oil and gas and the budget were discussed, according to a statement issued by Talabani’s office.

Explaining the content of the differences and referring to the Federal Court’s decision, the Deputy Prime Minister said, “We have no problem with those who sell oil, but our problem is to ensure the budget and the financial and constitutional rights of the Kurdistan Region,” calling on the United States to provide more assistance in finding constitutional solutions. For the differences between Erbil and Baghdad.

In another topic of the meeting, the political situation in Iraq and the latest political developments in Baghdad were discussed. The two sides agreed on the need for the political parties to solve their problems through the national dialogue, and to avoid any statements or positions that would deepen the conflict and tensions.

On Tuesday (15 February), the Federal Court issued a decision “unconstitutional of the oil and gas law of the Kurdistan Regional Government, with its obligation to hand over all oil production from oil fields in the region and other areas from which the Kurdistan Ministry of Natural Resources extracted oil and handed it over to the federal government represented by the Ministry of Federal Oil and enable it to use its constitutional powers regarding oil exploration, extraction and export.

At the time, the President of the Kurdistan Region, Nechirvan Barzani, described the decision as “unconstitutional” and was based on a law of the time of the previous regime, and the regional government stressed that “such an unconstitutional decision cannot be accepted.”

And the Kurdistan Region began to sell its oil in isolation from the federal government, after a stifling financial crisis as a result of the collapse of oil prices during the ISIS invasion of areas in Iraq, in addition to the disputes with Baghdad that prompted the latter to stop paying the salaries of the region’s employees.

Baghdad says its national oil company, SOMO, is the only one authorized to sell Iraqi crude oil, but each side claims the constitution is on its side. Since the Iraqi oil and gas law remained imprisoned in the drafting stage due to differences, there was room for maneuver.

The oil file is one of the most prominent outstanding issues between Baghdad and Erbil.

Baghdad used to pay 453 billion Iraqi dinars per month (about $380 million) as salaries to the employees of the Kurdistan Region, but it stopped them after the region conducted the independence referendum on its part, and because of what Baghdad said that the region was not committed to handing over its oil in accordance with the terms of the federal budget.

After several rounds of political negotiations, the region was obligated, according to an agreement with the government in Baghdad, to hand over 250 thousand crude barrels per day of crude oil produced from its fields to the state-owned SOMO Company, and hand over the revenues to the federal public treasury.

Shafaq News/ The Secretary-General of the Sadrist bloc, Nassar al-Rubaie, filed a lawsuit against the head of the State of Law coalition, Nuri al-Maliki, regarding the audio leaks attributed to the latter.

The lawsuit showed a request to issue an arrest warrant against Al-Maliki and prevent him from traveling.

And yesterday, Tuesday, an informed judicial source revealed to Shafak News Agency, that investigations are still in place in accordance with legal and fundamental procedures, with regard to audio leaks attributed to the owners.

And he indicated that “there are many specialized bodies participating in this investigation to reach the facts, and there is no pressure on the judicial authorities to close this file. Rather, there is a legal process that the investigation authorities are going through to announce the results in the near future.”

On the nineteenth of last June, the Supreme Judicial Council announced that the Karkh Investigation Court (in Baghdad) had received a request submitted to the Public Prosecution to take legal measures regarding the audio leaks.

In his speech, according to the recordings published by journalist blogger Ali Fadel, Al-Maliki touched on topics related to Sunni Arabs that were considered sectarian, in addition to describing the “popular mobilization” as “a nation of cowards”, while talking about arming clans and groups estimated at 20,000 fighters on the ground, asking him for support. Financially, logistically and legally, and he promised to provide this, in order to protect him from the leader of the Sadrist movement Muqtada al-Sadr, who wants to “slaughter everyone,” according to Al-Maliki.

The former prime minister also spoke about “financial and administrative corruption” in the PMF, and about the fact that the “Badr” organization, led by Hadi al-Amiri, receives financial salaries for about 40,000 people, while it does not have that number on the ground.

After these recordings, the leader of the Sadrist movement, Muqtada al-Sadr, asked al-Maliki to surrender himself and those who sought refuge from the corrupt to the judicial authorities.

The “Technology for Peace” team, the most famous Iraqi technical team, had confirmed the authenticity of the recordings attributed to al-Maliki, and said that they were “not fabricated”, noting in a report published earlier, that “despite the repeated denials of the owners of those recordings, and his claim I fabricated it by quoting and fitting excerpts from his voice to appear in this way, but the observations we made about the audio clip prove otherwise.

Shafaq News / The Chinese ambassador to Iraq, “Cui Wei”, affirmed on Wednesday his country’s commitment to the fifth initiative for peaceful coexistence, including non-interference in Iraq’s internal affairs, while noting that the “Chinese agreement” comes to enhance trade exchange between the two countries.

Wei said, in response to a question from Shafak News Agency reporter, that “Iraq is for the people, and for any party or country in the world, to respect the choice of the Iraqi people,” calling at the same time “the political parties and Iraqis, to find an appropriate solution to the current crisis.”

The Chinese ambassador added: “Beijing trusts the wisdom of the political parties to resolve the crisis, noting that Iraq is one of the sources of the four ancient human civilizations.”

He explained that “the Chinese-Iraqi agreement is to enhance cooperation and exchange between the two countries, including the project to build schools in Iraq, and that the embassy does not interfere with the work of projects, and there are more projects within the agreement between Iraq and China.”

He continued, “Iraq is China’s third largest trading partner in the West Asia and North Africa region, and is also China’s largest supplier of crude oil,” noting that “in 2021, the total volume of trade exchange between China and Iraq amounted to $37.3 billion, and institutions participated in And Chinese companies are building a lot of projects, including oil fields, power stations, airports and schools.”

And Cui Wei said, “Chinese companies have made positive contributions towards the reconstruction of Iraq after the war, and Beijing will continue its cooperation with Baghdad to participate in building the Silk Road Belt.”

Regarding the return of Iraqi students to China to complete their studies, the Chinese ambassador confirmed that the problem has been resolved, saying: “Iraqi students can now enter Chinese territory without having to re-apply for a visa.”

The American newspaper “Washington Times” criticized Iraq’s growing cooperation with China, warning that Beijing is using “soft power” to penetrate the Iraqi economy, especially in the oil sector, in the absence of American interest, taking advantage of its relationship with Iraqi “militias”, and the atmosphere of corruption that exists in Country.

The Chinese agreement opened the door wide for Beijing to flow into the Iraqi economy sectors, a move that caused Western fears that Baghdad would become a hostage to the Chinese dragon, like many capitals of emerging Asian countries that have plunged into several economic crises because of their absolute dependence on Chinese investments.

Unlike the West, Beijing provides generous aid to Iraq without imposing political conditions on Iraqi leaders, such as achieving more democracy or pursuing structural reform policies for the local economy, so cooperation with China appears more attractive.

In October 2019, the former Prime Minister of Iraq, Adel Abdul-Mahdi, signed an agreement with China that activated the “oil for reconstruction” program, under which dozens of Chinese companies pledged to work in Iraqi infrastructure in exchange for Beijing receiving 100,000 barrels of oil per day.
