This means that the president of the age does not have the right to end the first session because the article [55] came as explicit text “The Council of Representatives elected in the first meeting of the President, then the first deputy and second deputy, by an absolute majority of the members of the Council, 54], which stipulates that “… the meeting shall be held under the chairmanship of the oldest members to elect the President of the Council and the two Vice-Presidents, and no extension may be allowed for more than the aforementioned period.” This means that the President and his deputies must be elected at the first meeting exclusively.

He also stated that “the elderly person is not entitled to interrupt the session and keep it open by any argument, because this violates the ruling of the Federal Supreme Court, which is responsible for monitoring the constitutionality of laws and legislations.” The ruling of [55 / federal / 2010] 2010, to “make the first meeting of the House of Representatives [open] and to an unspecified time without the support of the Constitution has constituted a violation of its provisions and confiscated the concept of the first meeting and the objectives of the article [55].”

The Iraqi parliament – whose mandate is nearing completion – adopted in an extraordinary session on Monday to discuss the election file, adopted a resolution calling on all concerned parties and in accordance with its competence to take the means to restore confidence to the elections.

Eighty-five deputies submitted a request two weeks ago to hold a hearing to discuss what they said was the rigging of a young voter on May 12, in preparation for a vote to cancel the election results.

A parliamentary source told Ashqaf News that the decision of the session of the House of Representatives takes the degree of “recommendation”, stressing that “non-binding.”

He added that “Law No. 45 on the elections of the House of Representatives is valid and can not be higher than the law and objections to the results can be submitted as appeals to the Electoral Judicial Court in accordance with the provisions of the law.”

“Such decisions by the parliament are non-biding, meaning that they are merely suggestions and the government and other institutions are not obliged to accept the decisions,” the Kurdish lawmaker wrote on his Facebook feed. 

Iraqi Independent High Electoral Commission is expected to hold a meeting on Thursday and respond to the parliamentary decision. 

Riyaz Bardaran, head of the commission, said on Tuesday that the decision may escalate the political tensions and lead to a civil war.
